The Special Rapporteur has been mandated to pay attention to groups in vulnerable or marginalized situations, to apply a gender perspective, and to address the needs of children in the realization of the right to health.
For this, the Special Rapporteur keeps in mind relevant international human rights provisions, and in particular, Article 12 of ICESCR. A cornerstone protection of the right to health, this article introduces legally binding provisions that apply to all individuals. It is further elaborated in General Comment No. 14 of the Committee on Economic, Social and Cultural Rights (CESCR).

The Special Rapporteur also takes into account additional right-to-health protections for groups in vulnerable and marginalized situations. These protections are contained in group-specific international treaties: ICERD, CEDAW, CRC, CRPD), and other relevant instruments.

Activities of the Special Rapporteur

The Special Rapporteur implements the mandate through different means and activities, including:

  • Presenting annual reports to the Human Rights Council and to the General Assembly on the activities and studies undertaken in the view of the implementation of the mandate (see annual thematic reports);
  • Monitoring the situation of the right to health throughout the world;
  • Identifying trends related to the right to physical and mental health;
  • Undertaking country visits to get a first-hand account of the situation concerning the right to health in a specific country (see country visits);
  • Communicating with States and other concerned parties regarding alleged cases of violations of the right to health and other issues related to the mandate; and
  • Promoting the full realization of the right to health through dialogue with relevant actors by participating in seminars, conferences and expert meetings.
