Special Rapporteur on counter-terrorism and human rights
The urgent return and repatriation of foreign fighters and their families from conflict zones is the only international law-compliant response to the increasingly complex and precarious human rights, humanitarian and security situation faced by those women, men and children who are detained in inhumane conditions in overcrowded camps, prisons, or elsewhere in northern Syrian Arab Republic and Iraq.
This process also requires a thorough individual evaluation of each woman and child from their human rights perspective, including cases involving gender-based violence and persecution against women who return from Syria and Iraq, including via third countries. An effective return process includes holding individuals accountable for violations of national and international law for serious and systematic crimes committed in Syria and Iraq as appropriate and commensurate with the available evidence. There must be recognition that women and children associated with ISIS may have also experienced extreme and significant human rights violations and gender-based violence during and prior to their detention.

On 25 and 26 January 2021, lead by the Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism, fifty-seven letters were sent to States urging repatriation. These letters raised concerns regarding a registration and verification exercise in Al-Hol and Al-Roj camps located primarily in North-East Syria where third-party nationals, primarily women and children, are currently deprived on their liberty. On 1 February 2022, the Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism, jointly with other Special Procedures mandate holders, sent seven communications to States urging them to repatriate their nationals. These letters raised concern regarding the situation of boys and men held in various detention facilities in the Northeast of Syria in inhumane conditions and absent legal process or safeguards.
